 Meeting on Preservation and Use of Archeological Monuments in Altai Republic

LIENIP NewsThe Ministry of Culture of the Altai Republic held a meeting on preservation and use of archeological monuments in specially preserved territories and municipalities. The event was held on initiative of the Family indigenous community of Telengits “Mezhelik” (Kyzyl-Tash Settlement, Kosh-Agach District). V.E. Konchev, minister of culture of the Altai Republic, presided over a meeting. N.V. Tudenev, chairman of the Culture, Education, Science and Public Relations Department of the Altai Republic; B.K. Alushkin, El Bashchy of Altaians; I.V. Solodukha, chairman of Information Center “Birlik”; D. Mamyev, director of Nature Park “Un Enmek”; A.V. Edeshev, Aga-Zaisan of Kosh-Agach District; A.S. Surazakov, candidate of historical sciences of S.S. Surazakov Institute of Altaic Studies; A.V. Ebel, candidate of historical sciences of Anokhin National museum of the Altai Republic; directors of republican nature parks and media were invited to attend the meeting.
There are approximately 30,000 archeological monuments on the territory of the Altai Republic. If one take into account that one object may include tens of objects then the scope of the work becomes enormous. Development of infrastructure and growing number of tourists enhance damage and loss of unique historical and cultural monuments. Today mainly non-commercial organizations concern problems of these objects’ preservation, though these organizations cannon have staff inspectors because of lack of authority. Moreover most of discovered objects have no registration certificates and they are not registered, this makes it impossible to bring guilty persons to responsibility for damage. To solve the problem of inventory responsible authority, in this case, Agency on Cultural and Historic Heritage of the Altai Republic, do not have enough resources, transport, personnel and permissions. To make an inventory of one object one should address several total different agencies such as Ministry of Natural Resources, Ministry of Culture, Agency on Cultural and Historic Heritage of the Altai Republic, Land Use Committee, Architecture Department, etc.
Participants of the meeting met with support from all present public agents and they arrived at a common opinion that there should be complex discussion of the topic. Therefore on the initiative of A. Shonkhorov, chairman of community “Mezhelik”, they decided to establish a Council on Preservation and Use of Historical and Cultural heritage under the Ministry of Culture of the Altai Republic. The Council’s key task will be improvement of normative base for this field.
A bonus to the event was handing of Telengit house of worship “Takyl” registration certificate to R. Tadyrov, chairman of Kosh-Agach Community Association “Ere-Chui”. Representatives of the Muslim community “Tablik” have attempted destroying and defacing of “Takyl”. Now such actions will not remain unpunished.

 Meeting of Karelian Organizing Committee on Second International Decade of the World's Indigenous People

LIENIP NewsMeeting of Karelian Organizing Committee on Second International Decade of the World's Indigenous People was organized by the Ministry of the Republic of Karelia on National Politics and Relations with Religious Associations and held on 2 December, 2009 in Petrozavodsk. Representatives of public authorities, republican ministries and departments and members of public organizations took part in it. Elizaveta E. Kharitonova, head of the Indigenous Peoples’ Government Assistance Programs Department of the Ministry of the Republic of Karelia on National Politics and Relations with Religious Associations, gave information on republican actions for 2008-2009 concerning implementation of the Second International Decade of the World's Indigenous People on the territory of Karelia. Elena V. Bogdanova, deputy minister of the Ministry of the Republic of Karelia on National Politics and Relations with Religious Associations, represented draft program of republican actions for 2010-2011: improvement of normative legal instruments concerning protection of indigenous peoples’ rights; development of effective economic measures to support traditional living of indigenous peoples; organizational and technical arrangements in the field of health care of indigenous peoples including healthy-life propaganda; organizational and technical arrangements in the field of education of indigenous peoples; ethnocultural programs, projects, arrangements; information and methodical activity; preservation and propaganda of cultural heritage and development of traditional culture of indigenous peoples; All-Russian and interregional action and international collaboration. Members of Organizing Committee suggested amending and specifying certain points in the program of republican actions for 2010-2011.

 Meeting of Members of the Youth Coordinating Committee in Petrozavodsk

LIENIP NewsThe meeting of the Youth Coordinating Committee took place in the Ministry of the Republic of Karelia on National Politics and Relations with Religious Associations on 12 November, 2009. The meeting was aimed at activization of the Committee’s activities, work scheduling at the end of the current year and acquaintance with new members of the Committee. Leaders and members of youth public organizations of Petrozavodsk and the republic took part in the meeting. Andrey A. Manin, minister of the Republic of Karelia on National Politics and Relations with Religious Associations, opened the meeting. The Youth Coordinating Committee under the Ministry is established to form effective system of interaction between youth leaders of national public associations undertaking activities in the field of intercultural dialogue.

 Seminar on Legislation in the Field of Rights of Indigenous Peoples in Petrozavodsk

LIENIP News An interregional seminar “Basic Principles of Indigenous Legislation. A Modern Approach to the Training of Experts in the Field of Preservation, Development and Use of the Veps Language” took place in Petrozavodsk on 11 November, 2009. The Karelian regional public organization “Youth Legal Information Center of Indigenous Peoples “Nevond” and public educational organization of Karelian Republic “Institute of Further Educationalists’ Training” organized the seminar with the assistance of the Ministry of the Republic of Karelia on National Politics and Relations with Religious Associations. Participants from Kondopoga, Prionezhsky, Prjazha, Kalevala and Olonets Districts of Karelia were at the seminar. Laura Syratusa, linguist and ethnographer from Italia, who came to Karelia to get acquainted with Veps culture and history and to learn Veps language, also took part in the seminar. Zinaida I. Strogalshchikova, chairman of the Karelian regional public organization “Society of Veps Culture”; Elizaveta E. Kharitonova, head of the Indigenous Peoples State Support Programs Department of the Ministry of the Republic of Karelia on National Politics and Relations with Religious Associations; Nina G. Zaitseva, head of the Linguistics Department of the Institute of Language, Literature and History of Karelian Scientific Center of Russian Academy of Science, scientist; Irina A. Bondarenko, coordinator of the Karelian regional public organization “Defence and Future”, lawyer; Elena A. Leontyeva, deputy director of the Karelian regional public organization “Youth Legal The seminar participants received information on the United Nations' mechanisms for protecting rights of indigenous peoples; principal federal legislation passed in accordance with constitutional regulations of rights of small-numbered indigenous peoples; last government decisions in the field of protection of indigenous peoples' rights; implementation of state support programs of Baltic-Finnish peoples of the Karelian Republic aiming to exercise the rights of Karelians, Vepses and Finns of the Karelian Republic to preservation, development, study and use of native languages and cultures.

 International Seminar ''Traditional Knowledge of Indigenous Peoples: Issues of Preservation and Legal Protection. International and National Aspects''

LIENIP NewsThe international seminar “Traditional Knowledge of Indigenous Peoples: Issues of Preservation and Legal Protection. International and National Aspects” for representatives of small-numbered indigenous peoples of the North, Siberia and the Far East was held on 22-23 October 2009 in the hall of the Academic Senate of the Russian Academy of Civil Service (RACS). 54 representatives of indigenous communities and organizations from 19 subjects of the Russian Federation, 2 representatives of WIPO, 5 representatives of the federal authority and 2 far and near abroad indigenous representatives (71 persons in all) took part in the seminar.
On the first day of the seminar WIPO representatives briefly reviewed WIPO’s activities. In their reports and presentation they paid special attention to intellectual property of indigenous peoples’ traditional knowledge and gave examples of legal protection of indigenous peoples’ traditional knowledge abroad. Rospatent representative informed the seminar participants about the existing forms of traditional knowledge’s legal protection in the bounds of the Russian legislation. Large amount of information was offered during the seminar. Guides and literature fit for the seminar helped to facilitate perception of the legal material.

 Training course “Education in the Field of Human Rights and Rights of Indigenous Peoples” in Moscow

LIENIP NewsInterregional public organization “L’auravetl’an Information and Education Network of Indigenous Peoples” held a training course “Education in the Field of Human Rights and Rights of Indigenous Peoples” in Moscow on 13-20 October, 2009. Former interns of Regional Centers of Altai Krai and Altai, Khakass, Karelian Republics, representatives of public organizations and indigenous communities took part in it.
The training course’s program included meetings with such representatives of federal authority as: Aleksey P. Zenko, deputy director of the Department for Interethnic Relations for the Regional Ministry of Development within the Russian Federation; Andrey A. Nikiforov, deputy director of the Department for Humanitarian Affairs and Human Rights for the Ministry of Foreign Affairs, expert of the UN Permanent Forum on Indigenous Issues of the Russian Federation; Gennady D. Oleynik, chairman of the Committee on Issues of the North and Small-Numbered Peoples of the Council of Federation of the Federal Assembly of the Russian Federation; Piotr A. Yakhmenev, head of the Secretariat of the State Duma Committee on North and the Far East Problems; Dirk Hebecker, Senior Human Rights Advisor to the UN Country Team in the Russian Federation; Viktoria Kharchenko, coordinator of consistent program “National Minorities in Russia: Development of Languages, Culture, Mass-Media and Civil Society”.
Interns received information about the committees’ activities. They got the answers to their questions concerning legislation, traditional land use areas, benefits and subsidies, project activity. The training course participants were in the press conference of Stephen James Anaya, the UN Special Rapporteur on the situation of human rights and fundamental freedoms of indigenous people, who visited the Russian Federation and met indigenous representatives living in remote territories. During the press conference interregional public organization “L’auravetl’an Information and Education Network of Indigenous Peoples” presented Stephen James Anaya with translations of the Universal Declaration of Human Rights to indigenous languages of the Russian Federation.

 Seminar “Right to Education and Rights of Indigenous Peoples” in Krasnoyarsk Krai

The seminar “Right to Education and Rights of Indigenous Peoples” took place on 30 August 2009 in Pasechnoye Village (Tyukhtet District, Krasnoyarsk Krai). The villagers; N. Alin, head of the village board; A. Zabrodin, principal of the Ust-Chulsk comprehensive school; T. Kondiyakova, principal of the Pasechnoye primary school took part in the seminar.
The main issue of the seminar was closing of the Pasechnoye primary school. The issue has been under the control of the Krasnoyarsk Center since April 2009 after Pasechnoye villagers had sent the appeal on the matter (the site article “Pasechnoye Village in Krasnoyarsk Krai May Lose School”, 13 March, 2009). It will be recalled that the issue was brought up at the meeting of the North and Indigenous Peoples Committee of Krasnoyarsk Krai’s Legislative Assembly (the site article “Interns at the Meeting of North and Indigenous Peoples Committee of Krasnoyarsk Krai’s Legislative Assembly”, 28 March, 2009). The issue was also examined at the meeting of the Education, Science and Culture Committee of Krasnoyarsk Krai’s Legislative Assembly on 16 April 2009. The Committee passed the resolution ¹ 6-7 pursuant to which the Education and Culture Ministry and Tyukhtet District administration were recommended to take efficient measures to eliminate errors that led to refusal of license of educational activities and to reserve this educational organization.
In accordance with Tyukhtet District administration’s resolution ¹ 171-ï of 01 July 2009 the Pasechnoye primary school will be liquidated as a legal entity. Meanwhile the school will in fact exist as a subdivision of the Ust-Chulsk comprehensive school.
Before the school year the Pasechnoye school has been repaired. They have set a fire alarm and will set a dry closet. The school building is not in disrepair and there is no danger to life and health of children. If take into account certain improvements the school may be ready for training of four children who are going to enter Pasechnoye school this year. However most of errors due to which license of educational activities was denied to Pasechnoye primary school are still not eliminated for the lack of sufficient financial resources.
All the participants of the seminar confirmed the necessity of the school in Pasechnoye Village. The head of the village board shared the views of the seminar participants and guaranteed support in organization of the further preparation of the school for the work.
With the assistance of the Center the participants of the seminar decided to send appeals on the most complex issues to the Education, Science and Culture Committee of Krasnoyarsk Krai’s Legislative Assembly, Social Policy Ministries and Tyukhtet District administration.

 News from Khakassia

LIENIP NewsSummer is the time to make plans and apply for grants. After the chairmen of indigenous communities “Taymyr” and “Mystag” took part in the republican seminar “The Russian Federation Legislation and the Rights of Indigenous Peoples” organized by the regional public organization “Informational Center of Indigenous Peoples of Khakassia “Aran Chula” on May 14-15, 2009 they decided to apply the acquired knowledge immediately. They drew up projects aimed to preserve and develop traditional Shorian culture, traditions and customs, to cultivate love for the native land and regard for the nature in the youth and to promote the healthy life-style. Let us hope they will be lucky and get grants. Good luck to them!
Representatives of Khakass indigenous peoples will study at the prestigious Kh.Yasavi International Kazakh-Turkish University. Teachers of this university came to Khakassia on July 5-12 to administer a test. According to the results 6 most successful university entrants will become students and learn interesting and needed trades in a few years. Informational Center “Aran Chula” concluded a long-term association agreement with the university and undertook an obligation of information support and organization of tests in Khakassia. Our republic is in need of highly qualified national personnel.

 The IX Congress of the Youth Association of Finno-Ugric Peoples

The IX Congress of the Youth Association of Finno-Ugric Peoples took place on August 14-15 in Petrozavodsk.
The Youth Association of Finno-Ugric Peoples (MAFUN/YAFUP) is a youth association of public organizations of Finno-Ugric and Samoyedic (Ural) peoples and its primary intent is preservation and development of Finno-Ugric and Samoyedic (Ural) cultures and languages.
34 delegates and 19 observers from the Komi , Mordovia, Karelian, Mariy El and Udmurt Republics; Yamal-Nenets and Khanty-Mansi Autonomous Areas, Perm Krai, Tver Oblast, Moscow and St. Petersburg took part in the work of the congress. The forum discussed the issues of uniform information space formation, support of young families, development of languages and cultures of the Finno-Ugric peoples, improvement of educational system, preservation of identity of the Finno-Ugric peoples, development of youth ethnocultural tourism.
The congress delegates also discussed the Charter of the organization and approved the redrafted one. Aleksey Rassykhaev, chairman of MAFUN/YAFUP, made the directors’ report.
Elena Leontyeva, member of the Karelian regional public organization “Youth Information and Legal Center of Indigenous Peoples “Nevond”, made a report “Legal Education’s Impact on the National Morale of Finno-Ugric Youth” and she displayed the information on the work of the Center.
The congress participants shared experience and exchanged their opinions concerning preservation of language, traditional culture and folk arts and use of ethnocultural potential for socio-economic development of the territories.

 XIV Session of Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore

XIV session of the Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore (the Committee) of the World Intellectual Property Organization took place on 29 June – 03 July in Geneva.
The discussion focused on African Group’s proposal for renewal of the IGC’s mandate. In particular the proposal included the following issues:
• The IGC will carry on the work on genetic resources, traditional knowledge and traditional cultural expressions in the period from 2010 to 2011;
• The Committee’s work should be negotiations-based, strictly scheduled and include inter-session work;
• By the end of 2011 the Committee should work up legally binding instrument/instruments of traditional knowledge, traditional cultural expressions and genetic resources and submit it/them to the WIPO General Assembly.
Indigenous Peoples’ Forum consisting of indigenous representatives from different countries in whole entertained the African Group’s proposal on condition that they take valuable and equal part in it including inter-session work. Gulvayra Shermatova and Tatyana Kalyantagrau represented LIENIP during the work of the XIV session of the IGC.

 Presentation of Publication “Traditional Knowledge and Indigenous Peoples”

The L’auravetl’an Information & Education Network of Indigenous Peoples (LIENIP) and the World Intellectual Property Organization (WIPO) have joined their efforts to develop a publication “Traditional Knowledge and Indigenous Peoples” launched on 27 May 2009 during the VIII session of the Permanent Forum on Indigenous Issues.
Traditional knowledge is an important element of the intellectual and cultural heritage of indigenous peoples. It forms part of their social and historic identity and significantly contributes to their well-being and sustainable development.
The following speakers intervened on that occasion:
1. Mr. Kenneth Deer, Member of the Indigenous ICT Task Force, Mohawk representative in Kahnawake (Canada);
2. Mr. Rama Rao, Officer-in-charge, WIPO Coordination Office, New York;
3. Mr. Roberto Borrero, President and Chairman, NGO Committee on the UN International Decade of the World’s Indigenous People, United Confederation of Taino People, New York;
4. Dr. Jane Anderson, Visiting Scholar, New York University;

 VIII Session of Permanent Forum on Indigenous Issues

VIII session of Permanent Forum on Indigenous Issues started on 18 May in the UN headquarters, New York. Indigenous representatives from Africa, America, Australia, and Asia (including the Russian Federation) are taking part in the event. The meeting began with welcoming speeches of indigenous peoples in their own languages. All indigenous women joined hands, formed themselves into a ring in the hall and sang along with the song played on the tambourine. Most welcoming speeches were devoted to the role of indigenous women. Permanent Forum’s guidelines on economic and social development, implementation of the Second Decade of the World’s Indigenous Peoples and UN Declaration on the Rights of Indigenous Peoples were under discussion.
Meetings with Special Rapporteur of the Commission on Human Rights on the situation of human rights and fundamental freedoms of indigenous people and other special rapporteurs; six UN agencies and funds (Office of the High Commissioner for Human Rights (OHCHR), United Nations Development Program (UNDP), United Nations Population Fund (UNFPA), Food and Agriculture Organization (FAO), International Fund for Agricultural Development (IFAD), Economic and Social Department of the Secretariat) are scheduled.

 He Who Pays the Piper Calls the Tune

LIENIP NewsNon-government organizations are used to be financed by all manner of business entities, usually industrial companies. This interaction is logical – the companies damage traditional land use areas of indigenous peoples and pollute the environment so they should bear responsibility for it, including financial one. Unfortunately there are still no federal norms to define the procedure and amount of indemnification. Therefore there are no common regulations of indemnification to indigenous peoples. In this situation regional and local authorities are free in definition of this interaction within the law. Regulations that guarantee protection of indigenous peoples on the one hand and legitimacy of industrial companies’ activities on the other hand are developed and adopted only in the most advanced in respect to indigenous law federal subjects (Krasnoyarsk Krai is none of them). Public agencies, indigenous peoples and industrial companies reach tripartite agreements guaranteeing equal in rights conditions for all parties. This model of interaction is perhaps not the best but the most developed one in present conditions of adequate legal norms absence. But even this variant is being applied only in most developed territories. In most cases business entities finance indigenous organizations and thereby they provide legitimacy of their activities as if they help indigenous peoples. But how effective is this model of interaction? The question becomes sharpest in case of making vital decisions for indigenous peoples (e.g. problem of serious man’s impact on places indigenous peoples live in, plans of anthropogenic land transformation especially when it comes to global ecological changes). In these cases financing of one-time actions of some non-government organizations of indigenous peoples is not enough. Does really he who pays the piper call the tune? On a large scale – yes. The question is how. There are a lot of modern effective forms of interaction. One of them is establishment of indigenous peoples support funds. Such funds should be absolutely financial structures. There are a lot of ways to control the fund activities – public control, council of trustees, obligatory publication of reports and financial statements, auditing, etc. It is possible to provide the maximum transparence of the fund’s activities, much higher than the possibility to control public associations’ activities (it is not talked of public funds). What can a fund finance? For example, special grant programmes for indigenous peoples. Grant competitions acquired a reputation as effective way to support initiatives including those of indigenous peoples. They may be scholarship programmes, accommodations, etc. And the most important thing is that funds may finance specially developed expert programmes of development of indigenous territories and peoples. Companies may support these programmes even without establishment of special funds. And this will not be a one-time situational support of certain indigenous organizations selected on vague basis.

 Proposals of Workshop “Human Rights and International Aid and Defense Organizations” Participants

A legal workshop “Human Rights and International Aid and Defense Organizations” took place between 27 and 30 April 2009 in St. Petersburg. It was organized by Diakonisches Werk (Germany). The workshop was aimed to provide insight into the UNO human rights mechanisms, UN and CE structures and agencies. 15 non-commercial human rights and social organizations from Ukraine and Russia working with disabled persons, homeless, HIV- positive, sexual minorities, victims of violence, trade unions, migrants, prisoners, indigenous peoples, etc. took part in the event.
The workshop enabled its participants to reveal the state of target groups they represent, challenges and potential. They presented their practices in problem solving, effective working techniques with target groups and activities at national level. Civil movement mainstreaming in Russia was also discussed.
The participants obtained information about CE remedies.
Correlation of various human rights necessitates complex solution of social and economic rights. At the end of the workshop the participants:
1. stated that the Russian Federation Constitution and federal law exercise civil social and economic rights. According to 7th article of the Constitution Russia is a social State. And according to pt. 4, article 15 of the Constitution “The universally-recognized norms of international law and international treaties and agreements of the Russian Federation shall be a component part of its legal system”;
2. stated the Russian Federation’s ratification of International Pact on Economic, Social and Cultural Rights and European Convention on Human Rights and Fundamental Freedoms. Thereby the Russian Federation undertook to create favourable conditions for protection and execution of economic and social rights of citizens;
3. approved the Russian Federation’s decision to ratify European Social Charter;
4. noted that ratification of international treaties does not imply effective protection of rights in national law;
5. declared the necessity to combine efforts of government, civil society and unprotected population groups in protection and execution of economic and social rights.
The participants also decided to contribute to protection of social and economic rights in Russia by means of:
1. initiation of coalition of non-government organizations supported by Diakonisches Werk;
2. joint preparation of the alternative report about the Russian Federation’s implementation of International Pact on Economic, Social and Cultural Rights;
3. attraction of other non-government organizations to preparation of the alternative report in their regions and other kinds of activities;
4. making LIENIP responsible for preparation of the alternative report.
